These Terms of Use govern your use of the tunchertourism.com website and any tour you book with Ephesus Private Tours, operated by TUNCHER TURİZM LİMİTED ŞİRKETİ, a limited liability company registered in Türkiye and licensed by the Association of Turkish Travel Agencies (TÜRSAB) under the agency title Tuncher Prive Tourism Agency, licence document no. 18210. They cover both the website itself and the terms on which we sell single-day private shore excursions.

By browsing this website, sending us an enquiry, or booking a tour, you agree to these terms. Please read them carefully, particularly the sections on booking, cancellation, and liability.

Using this website

You may use this website to browse our tours, read about our company, and contact us with an enquiry. You do not need to create an account to do any of this.

You must not scrape, harvest, or extract data from this website by automated means, and you must not use the website in any way that could damage it, overload it, or interfere with other visitors.

Intellectual property

The text, photography, itineraries, logos, and other content on this website belong to us or are used under licence. You may view and share pages for your own personal, non-commercial use, but you may not copy, reproduce, or republish our content without our prior written permission.

Tour information and prices

Prices are shown in euros, per person, and are current at the time of publication. What is included and excluded for each tour, such as entrance fees, meals, and gratuities, is confirmed in writing for the specific tour you are booking.

Prices may change at any time before a booking is confirmed. Once we have confirmed your booking in writing, we will honour the confirmed price.

How a booking is made

Submitting our enquiry form or sending us a WhatsApp message is a request for a tour, not a confirmed booking.

A binding contract is formed once we confirm your booking in writing, by email or WhatsApp.

Once your tour and date are confirmed, you may pay online if you wish – either through a secure payment link we send you, or by bank transfer, whichever you prefer. Payment made this way covers the full tour price.

Paying online is optional. Your booking is confirmed by our written confirmation, and does not depend on payment being made first. Payment arrangements are set out in that confirmation.

We never handle your card details. Payments made by link are processed by the payment provider on their own secure page – card details are never entered on our website and are never seen or stored by us.

Until we have confirmed your booking in writing, we cannot guarantee your date, guide, or vehicle.

Cancellations and changes

You may cancel free of charge up to 24 hours before your tour’s scheduled start time, and anything you have already paid is refunded to you in full.

If you cancel within 24 hours of the start time, or do not show up, please contact us as soon as you can. Because a guide and vehicle are reserved specifically for you and committed by that point, we cannot guarantee a refund for cancellations inside that window.

If we need to cancel or reschedule your tour for reasons of safety, weather, or other events beyond our control (force majeure), you receive a full refund of anything you have paid, or you can move your tour to another date.

If you would like to change your date or itinerary after booking, let us know and we will do our best to accommodate you, subject to availability.

Where a refund is due, it is returned by the same method the payment was made, wherever possible.

Right of withdrawal

Under Art. 15 of the Turkish Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), leisure and travel services to be performed on a specific date or within a specific period are exempt from the standard 14-day right of withdrawal that applies to most distance sales. This means our cancellation policy above, not a general withdrawal right, applies to your booking.

An equivalent exemption exists under EU consumer law for leisure services tied to a specific date or period of performance.

Not a package tour

Our tours are single-day excursions lasting less than 24 hours, with no overnight accommodation. For that reason, they fall outside the scope of the Turkish Package Tour Contracts Regulation, and these Terms of Use, rather than that regulation, govern your booking with us.

Cruise passengers and returning to your ship

Most of our guests are cruise passengers, and we plan every itinerary with a substantial time buffer to get you back to port well before all-aboard time.

We make every reasonable effort to return you to your ship on time, but this is a best-efforts commitment, not an absolute guarantee: traffic, weather, and conditions at archaeological sites are outside our control.

If you are genuinely delayed because of something within our control, we will do what we reasonably can to help you reach your ship’s next port of call. This assistance is offered on a reasonable-efforts basis and does not amount to a promise of unlimited compensation.

Your responsibilities as a guest

To help your tour run smoothly, please:

  • Arrive on time at the agreed pickup point.
  • Carry valid travel documents and identification for your shore excursion.
  • Tell us in advance about any mobility or health limitations that might affect your tour.
  • Follow your guide’s safety instructions at all times.
  • Respect the rules of the archaeological sites you visit.

Health, mobility and suitability

Ephesus has uneven marble surfaces, exposure to heat, and considerable walking distances. Please assess honestly whether a tour is suitable for you or anyone in your group, taking these conditions into account.

Our Jeep Safari tour is limited to 1–9 guests due to vehicle capacity. If you are unsure whether a tour suits your needs, contact us and we can advise on more accessible options.

Conduct and our right to refuse

We may end a tour without a refund if a guest’s behaviour is unsafe, unlawful, or seriously disruptive to the guide, driver, or other guests.

Weather, force majeure and site closures

Ephesus and the House of the Virgin Mary are managed by the Turkish state and may close without notice, for reasons including weather, maintenance, or official events. If this happens, we will offer a suitable alternative itinerary. If we are unable to run the tour at all, anything you have paid is refunded in full, or your tour is moved to another date; if only part of the planned itinerary could not be delivered, we offer a proportionate refund or price reduction.

Travel insurance

We do not provide travel or medical insurance. We strongly encourage every guest to arrange their own travel insurance before their tour.

Liability

We are liable for damage caused by our own fault in providing our services. To the extent permitted by law, we exclude liability for indirect or consequential loss.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded or limited under Turkish Consumer Protection Law No. 6502 or the mandatory consumer protection law of your country of residence.

Photography and media

Our guides may take photographs during your tour, and we may use these for marketing, including on our website and social media. If you would prefer not to be photographed, please tell your guide. If you would like a photograph of you removed after the fact, email info@tunchertourism.com and we will action your request.

Governing law and disputes

These terms are governed by Turkish law. Disputes fall within the jurisdiction of the İzmir Consumer Arbitration Committees (Tüketici Hakem Heyetleri) for claims below the relevant threshold, and otherwise the İzmir Consumer Courts.

If you are a consumer resident in the European Union or United Kingdom, you retain the protection of the mandatory consumer-law rules of your country of residence, and you may be able to bring proceedings there where the law so provides.

EU consumers can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr to raise a complaint about an online purchase.

Changes to these terms

We may update these Terms of Use from time to time, for example if our services or the law change. The “Last updated” date at the top of this page shows when it was last revised, and any new version will be published on this page.
